This regulation details the compensation, support and resettlement mechanisms when the State acquires land in Ho Chi Minh City. The main content of the regulation includes:
(i) Subjects of application: This regulation applies to organizations and individuals whose land and assets attached to land are recovered in Ho Chi Minh City, including:
(1) State agencies and organizations performing land management tasks;
(2) Users of recovered land and owners of assets attached to land;
(3) Other related subjects such as organizations and individuals whose production and business activities are affected by land recovery.
(ii) Temporary housing and resettlement support: People whose land is recovered will be supported with housing rental costs while waiting for resettlement with support levels ranging from 6,000,000 to 8,000,000 VND/household/month, depending on the area and number of people. In addition, people can receive an additional 5% of the land compensation value if they arrange new housing themselves.
(iii) Bonus for handing over land before the deadline: The new regulation encourages households and organizations to hand over land early with a bonus of up to 200,000,000 VND. This is an important motivation to help land recovery projects proceed quickly and smoothly.
(iv) Production and business support: Organizations and individuals whose businesses are affected by land recovery will be supported with 30% of their after-tax income for 3 consecutive years, helping them stabilize production and overcome difficulties during the transition period.
This regulation demonstrates the strong commitment of the Ho Chi Minh City People's Committee in ensuring the rights of people and organizations and creating favorable conditions for urban development projects.
