On November 7, 2024, Vietnam Electricity (EVN) sent Official Letter No. 6315/EVN-TTD+QLĐT+PC to the Ministry of Industry and Trade, providing feedback on the draft Circular regulating the evaluation criteria for bidding documents and the standard bidding documents for selecting investors to implement power projects. EVN's proposals aim to ensure clarity, transparency, and efficiency in the investor selection process while aligning with current legal regulations.

Official Letter 6315/EVN-TTD+QLDT+PC issued by Vietnam Electric  providing feedback on the draft Circular regulating the standards for evaluating bid documents and the standard bidding documents for selecting investors to implement power projects

The main points of this Official Letter are:

(i) Applicable Entities: EVN proposes that the draft should apply only to projects outlined in Clause 1, Article 70 of Decree 115/2024/ND-CP, concerning the use of non-state budget funds.

(ii) Investment Evaluation Criteria: It is recommended to specify technical evaluation criteria in the Bidding Documents to ensure clarity, including the suitability of the investment plan and technical criteria specific to each type of plant.

(iii) Investment Efficiency Assessment: It is suggested to require investors to provide a detailed electricity price breakdown, including fuel costs, and to establish a method for evaluating electricity prices based on a discount rate, ensuring that the total electricity price falls within the regulated price framework.

(iv) Bidding Document Template: EVN requests the inclusion of provisions on negotiating electricity prices and power purchase agreements post-bidding, ensuring consistency with Circular 07/2024/TT-BCT and the Draft Electricity Law.

EVN submits the above recommendations to the Ministry of Industry and Trade for consideration.
