Decision 100/2024/QD-UBND issued by the People’s Committee of Ho Chi Minh City regarding regulations for conditions of land plot division, conditions for land plot consolidation, and minimum land area for division in Ho Chi Minh City

On October 31, 2024, the Ho Chi Minh City People’s Committee issued Decision No. 100/2024/QĐ-UBND, regulating the conditions for land parcel separation, consolidation, and the minimum area required for parcel separation within the city. This decision replaces Decision No. 60/2017/QĐ-UBND and updates key regulations to effectively manage land subdivision and parcel separation.

Decision 100/2024/QD-UBND issued by the People’s Committee of Ho Chi Minh City regarding regulations for conditions of land plot division, conditions for land plot consolidation, and minimum land area for division in Ho Chi Minh City

 The main points are:

(i) Conditions for Plot Division and Consolidation: Must adhere to the principles set out in the Land Law. Shared pathways between multiple land plots require mutual agreement and approval from local authorities.

(ii) Minimum Area Requirements:
- Residential Land:
+ Zone 1 (central districts): minimum 36m².
+ Zone 2 (other districts and district towns): minimum 50m².
+ Zone 3 (outlying districts): minimum 80m².
- Agricultural Land: minimum 500m² for annual crops, 1,000m² for perennial crops and aquaculture.

This decision replaces Decision No. 60/2017/QD-UBND dated December 5, 2017 which regulated the minimum area required for land plot division.
