SITUATION OF HANDLING LAND-USE INVESTMENT PROJECTS IN HO CHI MINH CITY

On June 12, 2023, the Department of Planning and Investment of Ho Chi Minh City (the DPI) issued the Official Letter No. 6824/SKHĐT-KTĐN on reporting the situation of handling investment projects using land to prepare for the meeting of the Working Unit to remove difficulties for investment projects in the city, sent to the People’s Committee of HCMC.

SITUATION OF HANDLING LAND-USE INVESTMENT PROJECTS IN HO CHI MINH CITY

On June 12, 2023, the Department of Planning and Investment of Ho Chi Minh City (the DPI) issued the Official Letter No. 6824/SKHĐT-KTĐN on reporting the situation of handling investment projects using land to prepare for the meeting of the Working Unit to remove difficulties for investment projects in the city, sent to the People’s Committee of HCMC.

 

In this Official Letter, the DPI has reported to the People’s Committee the following main contents:

1. For the group of projects that require approval of investment policies:

1.1. For 62 projects that do not meet the conditions to be the investor of housing projects (according to attached Appendix 1): DPI proposes not to approve the investment policy for these projects, and at the same time informs the investor of the refusal.

1.2. For group of 55 projects being considered for settlement (according to Appendix 2 attached):

  • If the projects face difficulties due to legal problems: the DPI recommends the People's Committee to assign the Department of Construction, Department of Natural Resources and Environment, and Department of Planning and Investment to verify the remaining problems.
  • If the projects are being inspected by competent authorities: the DPI recommends that after receiving the conclusion of the inspection, they will handle the projects at the request of the competent authorities in consistent with the law.
  • For projects with other problems under the consideration of the City: propose relevant departments (Department of Natural Resources and Environment, Department of Construction, Department of Planning and Investment, Department of Transport...) consider and coordinate with each other to come up with solutions.

 

2. For project groups requesting adjustment of investment policies:

2.1. For 19 projects that are having problems with the application of legal regulations: propose relevant departments to have opinions, propose to DPI and People's Committee to resolve.

2.2. For group of 31 projects:

  • For projects with problems due to the previous legal review process of project implementation: propose the People's Committee to assign the Department of Construction to review the legality and send it to the Department of Planning and Investment for synthesis.
  • For projects that have problems because they are in the process of being inspected by competent authorities: assign the Department of Natural Resources and Environment to soon conclude the inspection so that the DPI will soon have a basis for implementation.
  • For the remaining projects under consideration: propose the People's Committee to consult departments, give feedback to the DPI for them to work, and urge investors to add documents soon.
  • For projects that have just been received, are in the process of collecting opinions from agencies, so difficulties have not been identified: propose the People's Committee to assign relevant departments to send comments to the DPI soon.
