SUMMARY OF DOCUMENT 9801/BKHDT-KTCNDV REGARDING COMMENTS ON THE DRAFT PROPOSAL AND DRAFT DECISION OF MINISTRY OF PLANNING AND INVESTMENT

Regarding the draft Proposal to the Prime Minister, MPI proposed that the Ministry of Industry and Trade (MOIT) review the capacity scale of centralized solar power projects in localities to ensure the electricity source structure in the Power Development Plan VIII (PDP8). This is to avoid legal disputes if the principle of inheritance is not ensured in the planning activities, implementing the development orientation. Regarding the assignment for localities to develop a list of renewable energy projects, Deputy Prime Minister Tran Hong Ha instructed the MOIT to guide localities before November 5, 2023, on specific criteria for localities to review ongoing projects meeting the requirements for inheritance and continued implementation for transitional projects and propose new projects to be included in the Plan. According to the draft Proposal, the MOIT has issued Document No. 7704/BCT-DL on November 2, 2023, requesting the People's Committees of provinces and centrally-run cities, based on the criteria, to propose a list of projects related to energy sources and power grids in their respective areas. In cases where the conditions for compiling the list have not been met at the local level, it is recommended that the MOIT review the proposed lists from localities to refine the list of renewable energy projects, ensuring that projects can be implemented efficiently and aligned with the goals of the DPD8

Regarding the draft Decision of the Prime Minister, In the organizational implementation: MPI is the leading agency responsible for developing mechanisms and policies to improve the investment environment and overall bidding procedures. The development of mechanisms and policies for sector-specific development falls within the functions of specialized management agencies. Therefore, for the two assigned tasks for MPI, it is proposed that the MOIT take the lead in (i) developing transparent and publicly conducted bidding mechanisms for selecting investors for electricity projects; (ii) establishing mechanisms and policies to attract foreign investment, Official Development Assistance (ODA), and private investment for the comprehensive, balanced, and sustainable development of the electricity sector. MPI will coordinate and implement these tasks according to the assigned functions and responsibilities. MPI also proposed a clear differentiation of authority and responsibility between the MOIT and localities in developing the list of renewable energy projects (excluding offshore wind power).This is to ensure consistency and adherence to legal regulations regarding planning and electricity.
